Supreme Court of Denmark

Expulsion and six-year entry ban

Case no. 58/2012
Judgment 24 August 2012
The Public Prosecutor
vs.
T

Expulsion and six-year entry ban

T, an Iraqi citizen, had been sentenced to imprisonment for 50 days for infringement of s. 59(1)(2) of the Danish Aliens Act on stays in Denmark without the requisite permit and for two counts of forgery as he had used a false Bulgarian identity card.

The Supreme Court found that, due to the prison sentence that T had been given, it was possible to expel him under the Aliens Act, and that expulsion would not be in contravention of Denmark's international obligations.

Consequently, the Supreme Court amended the High Court's judgment with regard to the issue of expulsion.

The case before the Supreme Court only concerned the issue of expulsion.
